Criminal labour law

Criminal labour law is a field of commercial criminal law covering criminal penalties and administrative fines specifically related to the labour market.

These include 

  • benefit fraud
  • blocks on participating in calls for tender
  • illegal employment
  • illegal employment of foreigners
  • income tax fraud
  • job placement
  • minimum wage
  • posting of workers
  • supply of temporary workers
  • withholding of payments
  • workers' health and safety
  • working time law


This very complex material, which is regulated by many ancillary laws, is of great practical importance, not just to especially vulnerable sectors such as construction and restaurants. In recent years, criminal labour law has increasingly been the subject of academic discussion. We are participating in this debate as, for example, co-authors in the volume published by Ignor/Mosbacher (3rd edition 2015, in press) Handbuch Arbeitsstrafrecht and the publication of an overview of court rulings on the topic in the journal Zeitschrift für Haftung und Unternehmen (ZWH).
